💍 Your wedding photo on tombstone ads. Is it legal?

Sounds like nonsense or black humor, but this is a real case from judicial practice.
A newlywed couple from Penza accidentally saw their happy wedding photo... on a huge billboard for funeral services. They were smiling next to tombstones and wreaths.

Shock, scandal, court. The couple demanded compensation for moral damages.
But the photographer claimed he had the right to the photo 🤔

Who is legally right?
In Russia, Article 152.1 of the Civil Code (Protection of a Citizen's Image) applies.

Even if the photographer is the true author of the photo (which he is), he does not have the right to use your face for commercial purposes without written consent.

Where is the trap? 🪤
Lawyers often hide a line:
The Client grants the Photographer the right to use the images for portfolio, exhibitions, contests, and other commercial purposes.

By signing this without reading, you essentially allow your face to be sold to stock photo sites. And from there, anyone can buy it — from ads for diarrhea remedies to funeral agencies.
